- Sale of Show Potential Dog: The dog identified above, is sold on the terms and conditions as provided in this agreement. The pedigree is correct and given at the time of sale. This dog is being sold as a show potential dog, may be registered with the AKC and is free from disqualifying faults for the particular breed at the time of sale. This dog is not guaranteed to win in the show ring unless agreed upon in this contract at the time of execution. It is understood that with proper care on the part of the buyer, in due time, the dog should be of acceptable temperament and structure, and should embody the basic standards of the breed. The buyer acknowledges that he has knowledge of and understands the requirements and special care necessary for a show potential dog.
- Co-ownership: The dog will be registered in the name of the Seller and the Buyer as co-owners, and Seller will be entitled to possession of the dog at all times throughout this agreement. The seller will transfer sole ownership to the Buyer upon completion of all terms (including the obtaining of the AKC championship) and conditions and upon payment or receipt of all consideration under this agreement.
- Health problems: At the option and expense of the buyer this dog will be taken to a licensed veterinarian for a thorough health exam within 48 hours from the time of purchase. Provided the dog is returned to the Seller with a signed statement from the veterinarian setting forth the health problems of the dog, and certifying that such problems are of a debilitating and permanent nature, the Seller agrees to a full cash refund or replacement puppy at Seller’s option.
- Hereditary Defects: This dog is free from any hereditary crippling defects to 24 months of age. At the option of Buyer and provided Seller is furnished a signed statement from a licensed veterinarian stating the nature of the hereditary crippling defect, the Seller shall either: (a) refund the purchase price upon condition the dog and AKC title is returned to the Seller, or (b) replace the dog with another show potential dog at no additional cost to the Buyer.Should the Buyer, pursuant to (b) of the foregoing paragraph, elect to have the dog replaced with another show potential dog, buyer shall cooperate with the Seller in the sale and placement of the dog and further agrees that the sales price, if any, for the dog shall be payable to the Seller.
- AKC Disqualifying Faults: This dog is free from any AKC major or disqualifying fault or faults as stated in the breed standard at the time of sale. Should dog be determined to have a AKC disqualifying fault or faults within 18 months of purchase then buyer shall have the same rights as set forth in Paragraph 4 above.Determination of whether the dog has an AKC major or disqualifying fault or faults shall be determined by two (2) Wheaten Breeders. Buyer and Seller shall each choose one of the Breeders. Should the two (2) Breeders be unable to agree, then they shall pick one other Breeder to evaluate the dog and that Breeders determination shall be binding. Dismissal by two AKC judges shall be deemed a conclusive determination for the purposes of this paragraph.
- Showing Requirements: (a) If this paragraph is initialed the dog shall be shown, commencing at 6 months of age, to its AKC championship and buyer shall pay all expenses associated with such showing. Buyer acknowledges that the showing of this dog has been discussed with the Seller and that he is aware of the associated expenses and is further aware that the dog may on occasion be in the care of either the Seller or a handler for extended periods of time and may have to travel. Seller may show the dog if requested but shall not be entitled to any expenses associated with such showing other than entry fees and costs of transportation.
